General Terms and Conditions of Engadiner Kraftwerke AG (EKW) for the purchase and use of online tickets for the Munt La Schera road tunnel

1. Scope of application

These General Terms and Conditions govern the online purchase and use of the purchased tickets.

2. General regulations

The regulations are the basis for the use of the web shop and the purchase of a ticket through the web shop.

3. Online purchase of a ticket

The customer uses his/her hardware and software to purchase a ticket at own risk and costs and acknowledges that EKW cannot guarantee that each type of software and each operating system of a computer or smartphone of the customer shall be supported. EKW shall reserve the right to change or adapt the corresponding web shop without prior notice and restrict the operating times of the web shop or to suspend it temporarily.

Upon completion of the order and successful payment, the customer receives a confirmation e-mail. The ticket is then sent in a separate e-mail in the PDF format. The customer has the option of validating or producing the ticket in a printed form or using the smartphone at the paying agency. The printed form is subject to the following requirements: all online tickets with QR code must be printed in 100% size (not scaled) on a white, previously unused plain paper in the portrait format A4 with a resolution of at least 600dpi. The customer acknowledges that it shall be within his/her own scope of responsibility and risk to have all technical facilities, which are necessary for receiving and printing the ticket with QR code or for producing the ticket on a smartphone. Online tickets that are not properly readable shall be invalid for the travel. EKW shall not assume any responsibility in the event of damage of the devices during the ticket check.

4. Online ticket

Online tickets can be purchased exclusively for the following vehicle categories:
  • - Passenger and Delivery cars up to a maximum of 9 seats and 3.5t of total weight
  • - Caravans / camper vans
  • - Motorcycles.
For all other vehicle categories, the transit fees must be paid directly at the paying agency on the dam wall. If this restriction is not observed, the ticket can neither be upgraded to another category nor shall the customer be entitled to refund of the ticket. Upon demand of the collection staff, the customer must present the vehicle registration document for verifying the vehicle category.

If the ticket cannot be presented at the paying agency in a printed form or using a smartphone, the customer shall not be entitled to compensation or refund nor shall he/she be entitled for the passage through the road tunnel. The ticket purchased online is valid exclusively in the selected season (summer season from 01.05. to 30.11. / winter season from 01.12. to 30.04.) and for a maximum of three months from the time of electronic delivery. It is neither possible to upgrade the ticket to another season nor is the customer entitled to refund in case of redemption of the ticket outside the selected season and validity. Purchased weekday tickets (Sunday to Friday) can also be redeemed on Saturdays by paying a surcharge. The surcharge must be paid on site at the paying agency.

Tickets purchased online are basically not refundable nor can they be exchanged. The refund is also ruled out if the trip is not commenced as a result of illness, accident, force majeure or similar circumstances.

5. Modification of tariffs and the General Terms and Conditions

The General Terms and Conditions shall apply in their respective finalised version. EKW shall reserve the right to modify the General Terms and Conditions as well as the ticket prices at any time.

6. Data protection

When dealing with personal and customer data, EKW abides by the current data protection regulations. The data is not used for advertising purposes and is not disclosed or sold to third parties.

7. Liability

Any liability of EKW for damages including consequential damages of any kind, which result from the use of the web shop and the tickets purchased online, is fully ruled out to the legally permitted extent.

8. Applicable law and legal domicile

These regulations are exclusively subject to the Swiss Law. The legal domicile is Zernez, unless a different legal domicile is mandatorily prescribed by law.
